Solar FiT judgement set for tomorrow

It has been revealed that the decision as to whether the Government will win or lose their appeal is expected tomorrow morning however the Department of Energy and Climate Change (DECC) has not ruled out further legal action should they lose the appeal.
It is anticipated that High Court judges will reveal tomorrow whether they will grant the Government the chance to appeal over the ruling which declared the plans to cut the solar subsidy in half for installation post December 12th 2011 as unlawful.
It still remains unclear whether the tomorrow’s ruling will provide the industry with any clarity over the future of the feed-in-tariff (FiT) rates. Last week, Climate Minister Greg Barker confirmed that if the DECC loses the appeal the tariff will be reinstated to 43.3p/kWh until March 3rd when it will drop to 21p/kWh in April 21012. If they win the appeal, installs will continue to receive 21p/kWh until April 2012.
